Please read these Terms and Conditions (“Terms”) carefully before using the Real Clear Biogenix website or placing an order. By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Research Use Only — Important Notice

Our products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory authority for any medical or therapeutic use. Real Clear Biogenix is a research chemical supplier, not a compounding pharmacy or medical provider. Any use of our products outside of legitimate scientific research is strictly prohibited and is entirely at the buyer’s risk.

2. Agreement to Terms

By accessing our website at realclearbiogenix.com or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Real Clear Biogenix.

We reserve the right to update or modify these Terms at any time. Continued use of our website after such changes constitutes your acceptance of the revised Terms.

3. Eligibility and Permitted Use

To purchase from Real Clear Biogenix, you must:

• Be at least 18 years of age (21 in certain jurisdictions)
• Be a licensed researcher, scientist, or qualified laboratory professional with appropriate facilities, training, and legal authority to handle research-grade compounds
• Use our products solely for legitimate in-vitro scientific research in a controlled laboratory setting
• Be located in a jurisdiction where the purchase and possession of research chemicals is lawful
• Not resell our products or represent them as being suitable for human or animal use

By placing an order, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to refuse or cancel any order at our sole discretion, including orders we believe are placed by ineligible individuals or for prohibited purposes.

4. Products and Descriptions

We make every effort to accurately describe our products, including purity specifications, batch information, and Certificates of Analysis. However, we do not warrant that product descriptions, pricing, or other content is error-free, complete, or current. We reserve the right to correct errors and update information at any time.

Certificates of Analysis (COAs) are provided from accredited third-party laboratories and reflect results for a specific batch. COAs are informational and do not constitute a warranty of fitness for any particular purpose.

Product images are for illustrative purposes only. The appearance of products may vary.

5. Pricing, Orders, and Payment

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, which will be calculated and displayed at checkout. We reserve the right to correct pricing errors at any time, including after an order is placed. If a pricing error is identified after your order is submitted, we will contact you before processing.

Orders

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is confirmed only upon receipt of our order confirmation email. We may cancel orders at any time prior to shipment for any reason, including but not limited to product unavailability, pricing errors, or concerns about order legitimacy.

Payment

We accept major credit cards (Visa, Mastercard, American Express, Discover) and cryptocurrency. All transactions are processed through encrypted, PCI-compliant payment gateways. By providing payment information, you represent that you are authorized to use that payment method.

6. Shipping and Delivery

We ship within the United States only. Orders placed before 2:00 PM ET on business days are typically shipped the same day. Delivery typically takes 3–5 business days via USPS or UPS. Shipping times are estimates and are not guaranteed.

Free standard shipping is available on qualifying orders over $250 within the contiguous United States. Expedited shipping options may be available at additional cost.

Risk of loss and title for all products pass to you upon delivery to the carrier. We are not responsible for lost or delayed shipments once a package has been accepted by the carrier. If your shipment is lost or arrives damaged, please contact us within 7 days of the expected delivery date.

We are not responsible for delays or failures in delivery caused by events outside our control, including weather, carrier disruptions, or customs issues.

7. Returns and Refunds

Due to the sensitive nature of our research-grade products, we operate under the following return and refund policy:

• No returns on opened or used products. Once a vial has been opened or used, it cannot be returned.
• Unopened products may be eligible for return within 14 days of delivery, provided the product is in its original, unaltered condition and packaging.
• Damaged or incorrect orders will be replaced or refunded. Please contact us within 7 days of delivery with your order number and clear photographic evidence of the issue.
• Lost shipments will be investigated with the carrier. If confirmed lost, we will reship or issue a full refund at our discretion.

All return requests must be initiated through our support team at support@realclearbiogenix.com before sending any product back. Unauthorized returns will not be accepted.

Approved refunds are processed within 5–10 business days to the original payment method.

8. Intellectual Property

All content on our website — including text, graphics, logos, images, product descriptions, and site design — is the property of Real Clear Biogenix or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our site without our express written permission.

9. Disclaimer of Warranties

OUR PRODUCTS AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on our site.

OUR PRODUCTS ARE SOLD FOR RESEARCH USE ONLY. WE MAKE NO WARRANTIES REGARDING THEIR SUITABILITY FOR ANY CLINICAL, DIAGNOSTIC, OR THERAPEUTIC PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REAL CLEAR BIOGENIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or related to these Terms or your use of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Real Clear Biogenix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your use of our products or website; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any claim that your use of our products caused harm to a third party.

You agree to resolve disputes with us on an individual basis only and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the remaining Terms and will not affect the validity and enforceability of the remaining provisions.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Real Clear Biogenix with respect to your use of our website and the purchase of our products, and supersede all prior agreements, representations, and understandings.
